A fundamental goal of the federal Bankruptcy Laws is to give debtors a financial “fresh start” from burdensome debts. In Local Loan, the U.S. Supreme Court stated the purpose of Bankruptcy Laws: “[I]t gives to the honest but unfortunate debtor … a new opportunity in life and a clear field for future effort, unhampered by the pressure and discouragement of preexisting debt.” Local Loan Co. v. Hunt, 292 U.S. 234, 244 (1934).
The Court also stated:
“One of the primary purposes of the Bankruptcy Act is to ‘relieve the honest debtor from the weight of oppressive indebtedness, and permit him to start afresh free from the obligations and responsibilities consequent upon business misfortunes.’” Id. citing Williams v. U.S. Fidelity & Guaranty Co., 236 U.S. 549 (1915).
The goal of obtaining a financial fresh start is accomplished through the Bankruptcy Discharge Order. This is a Court Order that releases debtors from personal liability on their dischargeable debts. After discharge, debtors are no longer legally obligated to pay back those debts. It further precludes creditors from ever taking collection action against the debtor in an effort to collect on the debt.
