Before Bankruptcy “To-Do’s”

|

Bankruptcy is a complex area of law. It is a powerful tool that can help you get out of debt and back on your feet. However, there are a few “bankruptcy do’s” to be aware of before filing. There are also a few “bankruptcy don’ts” to be aware of – read our article Before Bankruptcy “Don’ts” for more info.

Before Bankruptcy Do Understand What Events Led to Your Debt Problem

The benefits of bankruptcy are vast, and we want all of our clients to get the most out of their bankruptcy discharge. This means having an understanding of the causes of your debt problems and doing what you can to make sure those problems are behind you. For example, maybe you ended up deep in medical debt due to a health issue, or deep in credit card debt after a job loss. So long as the health issue is resolved, or you are now gainfully employed, you can feel confident that you will not need to incur new debt and you can get the full benefit of debt relief from your bankruptcy.

Before Bankruptcy Do Hire The Right Bankruptcy Attorney

Bankruptcy is a specialized and intricate area of law. It is important that you hire an experienced attorney who understands the ins and outs of bankruptcy law. Hiring the wrong attorney can be expensive, as it can be costly and difficult to fix mistakes after a bankruptcy case is filed.

Take the time to research any attorney or law firm you’re considering. Some attorneys dabble in bankruptcy law, while others practice exclusively in bankruptcy. The Law Office of Barbara B. Braziel practices exclusively in bankruptcy law. We’ve been helping people get out of debt for over 35-years.

Here are a few critical things to consider when searching for the right bankruptcy attorney:

  • Does the attorney have experience in bankruptcy law?
  • Is the attorney able to answer all of your questions to your satisfaction?
  • Does the attorney seem organized, knowledgeable, and trustworthy? Are you comfortable with this person?
  • Will your case be handled by the attorney, or will you be left in the hands of a paralegal?
  • Does the attorney have a good reputation in the community?

These are some basic things to consider. We encourage you to do your research and hire the attorney who you feel comfortable with to help you navigate through the bankruptcy process.

Before Bankruptcy Do Complete the Mandatory Credit Counseling

A Credit Counseling course must be completed within 180-days prior to filing for bankruptcy. It can be completed online or over the phone. Generally speaking, it is straightforward, inexpensive, and not too time-consuming.  The course is designed to aid you in deciding whether or not you need to file for bankruptcy. When you finish the course you will receive a certificate of completion, which must be filed with the Bankruptcy Court.
